Welcome to Miratag, a service provided by Nordic Blue Communications LLC ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Miratag platform, including our website, mobile applications, and related services (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
Miratag provides a digital platform for creating, managing, and tracking checklists, quality control workflows, and operational tasks. The Service includes web and mobile applications, reporting tools, and related features.
To use certain features of the Service, you must register for an account. When you register, you agree to:
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.
Subscription Plans: The Service is offered on a subscription basis. Details of available plans and pricing are available on our website.
Billing: Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen plan. All fees are non-refundable except as expressly stated in these Terms.
Price Changes: We may change our prices at any time. Price changes will take effect at the start of your next billing cycle, and we will notify you in advance.
Free Trial: We may offer free trials. At the end of the trial period, your subscription will automatically begin unless you cancel before the trial ends.
Ownership: You retain all rights to the content you create, upload, or store using the Service ("Your Content"). We do not claim ownership of Your Content.
License: By using the Service, you grant us a limited license to host, store, and display Your Content solely for the purpose of providing the Service to you.
Responsibility: You are solely responsible for Your Content and must ensure it does not violate any laws or third-party rights.
You agree not to use the Service to:
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious code or interfere with the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any unlawful or harmful purpose
• Resell or redistribute the Service without authorization
The Service and its original content (excluding Your Content), features, and functionality are owned by Miratag and are protected by international copyright, trademark, and other intellectual property laws.
The Miratag name, logo, and all related names, logos, and slogans are trademarks of Miratag. You may not use these marks without our prior written permission.
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).
When you use the Service to process personal data of others (such as your employees), you act as the data controller, and we act as the data processor. We will process such data only in accordance with your instructions and applicable law.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We will make reasonable efforts to notify you in advance of planned maintenance that may affect the Service.
By You: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.
By Us: We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or engage in conduct that we determine is harmful to other users or the Service.
Effect of Termination: Upon termination, your right to use the Service will cease immediately. You may request export of Your Content before termination. We will retain Your Content for 30 days after termination, after which it may be deleted.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIRATAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Miratag and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.
